Distance Selling Agreement - Dynamic Currency Pricing

This Distance Selling Agreement is entered into between:

1. PARTIES

(Hereinafter referred to as the “Seller”)

BUYER:
The individual or legal entity who completes a purchase on the Seller’s website and whose details are specified in the order form.
(Hereinafter referred to as the “Buyer”)

By completing the purchase, the Buyer declares that they have read, understood, and accepted all terms of this Agreement.

2. SUBJECT OF THE AGREEMENT
The subject of this Agreement is the sale and delivery of the digital product, a software license for the “Dynamic Currency Pricing Pro” WordPress plugin (the “Product”), sold electronically by the Seller to the Buyer via the website https://wpdynamicpricing.com .

3. PRODUCT INFORMATION, PRICE, AND PAYMENT

Product Name: Dynamic Currency Pricing Pro for WooCommerce – 1 Year License
Description: A WordPress plugin that automatically updates WooCommerce product prices based on real-time currency exchange rates.
Price: As stated on the product page at the time of purchase. The price includes VAT where applicable.
Payment Method: Payment will be made online via credit/debit card or other methods offered by our third-party payment processor (e.g., iyzico).

4. DELIVERY OF THE PRODUCT
The Product is delivered digitally. Upon successful completion of the payment, the Buyer will receive an email containing a secure link to download the Product’s .zip file and a unique license key. The download link and license key will also be made available in the Buyer’s “My Account” section on the Seller’s website. The delivery is considered complete at the moment the download link and license key are made accessible to the Buyer.

5. LICENSE TERMS
The purchase of the Product grants the Buyer a non-exclusive, limited license to use the Product on a website. The license is valid for one (1) year from the date of purchase and includes access to product updates and technical support during this period. The terms of use are further detailed in our main Terms and Conditions.

6. RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw from this Agreement within 14 days without giving any reason.

However, pursuant to applicable consumer protection laws (e.g., EU Consumer Rights Directive 2011/83/EU, Article 16(m)), the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and his acknowledgment that he thereby loses his right of withdrawal.

By completing the purchase and proceeding to download or access the Product, the BUYER EXPRESSLY CONSENTS to the immediate performance of this contract and ACKNOWLEDGES that they will lose their right of withdrawal from the contract once the download or access to the digital content has begun.

Our Refund Policy, as detailed separately on our website, applies to requests made for technical reasons within the specified period.

7. GENERAL PROVISIONS

The Buyer may not reproduce, distribute, or create derivative works from the Product, except as permitted by its license (GPL).
The Seller is not liable for any damages, including but not limited to data loss or business interruption, resulting from the use or inability to use the Product.
All notifications regarding this agreement will be sent to the email addresses specified by the Parties.

8. DISPUTE RESOLUTION
Any disputes arising from this Agreement shall be governed by the laws of the Republic of Turkey. The Courts of [Your City, e.g., Trabzon] shall have exclusive jurisdiction over any disputes.

By clicking the “Place Order” button or equivalent, the Buyer confirms that they have received, read, understood, and accepted all articles of this Distance Selling Agreement and the Preliminary Information Form.
